Terms & Conditions

You have subscribed and expressly consented to receive SMS alerts and/or email/voice notifications on your mobile telecommunications device from SECO Energy for purposes of providing you notices and alerts regarding your account. By subscribing to this service, you agree to the following Terms and Conditions:

 

As a registered participant in SECO’s notifications program, you have the ability to text certain messages to SECO about your electric service and to receive text, email and voice updates about and communications regarding power outages.

 

By sending a text message for participation using SECO’s Notification System, you are agreeing to the Terms and Conditions set forth below. These Terms and Conditions may change from time to time, and SECO will post updates here. To participate, your phone must be enabled for SMS/text messaging. Certain features may require equipment upgrade for viewing.

 

You have the ability to permanently discontinue your participation in SECO’s notifications at any time by texting STOP to 69573. You also have the ability to temporarily discontinue your participation by texting PAUSE to 69573. You can also manage your notifications by clicking “Manage Notifications” at our new StormCenter landing page.

 

Please carefully review the following Terms and Conditions.

 

  1. Cost of Participation
    SECO Energy does not charge for SMS/text messages, email or voice notifications; however, your mobile service provider may charge for messages and data. The message and data rates which may apply would be charged by, and be payable by you, to your mobile service provider. Check with your carrier for details.
  2. User Conduct
    You agree not to send or otherwise make available content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, or contains hate speech.You acknowledge that SECO may or may not pre-screen text message content you provide, but shall have the right, without obligation and at its sole discretion, to pre-screen, refuse, or remove any content you make available, including content that violates this section.You agree to provide true, accurate and complete information about yourself during the SMS registration process and to update this information promptly when it changes. If you provide any information that is untrue or inaccurate, not current, or incomplete, or if we suspect that your information is untrue or inaccurate, not current, or incomplete, we may, at our sole discretion, suspend or terminate the notifications registration or access, or refuse current or future access.
  3. Rights
    By sending text messages, you grant SECO the perpetual, irrevocable, and fully sub-licensable license to use, distribute, reproduce, modify, adapt, publish, translate, publicly perform, and publicly display any and all text message content provided by you to SECO (in whole or in part) and to incorporate such content into other works in any format now known or later developed.
  4. Confirmation, Opting Out, or Asking Questions.
    You understand and agree that you may receive a confirmation text message for each text message you send to SECO. You may temporarily discontinue your participation in the SMS by texting PAUSE to 69573. To opt-out of or cancel the Text Service, please text STOP to 69573. If you experience any problems with opting out of the notifications, or if you need help or additional information related to the SMS/text, please text HELP to 69573You may also send an email (including your mobile phone number) to customerservice@secoenergy.com or call SECO at 352 793 3801.
  5. Privacy Policy
    Data obtained by SECO from you in connection with SECO’s SMS/text messaging service may include your cellular number, the name of your mobile service provider, the date, time and content of the text messages you send to us, and other information provided in the text messages you send to us. We may use this information to contact you, update your account, and to provide the text messages you have requested.   6. No Guarantee
    SECO’s notifications rely on communications networks beyond the cooperative’s control. During major events, such as hurricanes and tropical storms, text messages may not be available for affected areas. You acknowledge, understand, and agree that SECO shall not be held liable for any delays in the receipt of text, email or voice notifications to you. SECO cannot guarantee that notifications will not be incomplete, lost, late, or misdirected messages, including (but not limited to) undelivered messages resulting from any form of filtering by your mobile carrier or service provider.
  7. Disclaimer of Warranties
    You expressly understand and agree that your participation in SECO’s notifications is at your sole risk. The service is provided on an “as is” and “as available” basis. SECO and its subsidiaries, affiliates, officers, agents, employees, partners, contractors, consultants, licensors, and suppliers expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.SECO and its subsidiaries, affiliates, officers, agents, employees, partners, contractors, consultants, licensors, and suppliers make no warranty that (a) the notifications will meet your requirements; (b) the notifications will be uninterrupted, timely, secure, or error-free; or (c) the results that may be obtained from the use of the Notification System will be accurate or reliable.
  8. Limitation on Liability
    You expressly understand and agree that SECO and its subsidiaries, affiliates, officers, agents, employees, partners, contractors, consultants, licensors, and suppliers shall not be liable to you for any direct, indirect, incidental, special, consequential or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses, even if SECO has been advised of the possibility of such damages, resulting from the use or the inability to use the Notification System, unauthorized access to or alteration of your transmissions or data, statements or conduct of any third party regarding the notifications, or any other matter relating to the notifications.
  9. Termination
    SECO reserves the right, at its sole discretion, to cancel or suspend any or all of its notification services, in whole or in part, for any reason, with or without notice to you.
  10. Applicable Law and Disputes
    These Terms and Conditions and our relationship with you regarding SECO’s notifications service are governed by the laws of the State of Florida without regard to its conflict of laws principles. You and we agree to submit to the exclusive jurisdiction of the applicable court in Florida, and you and we hereby waive any jurisdictional, venue or inconvenient forum objections to such courts.
  11. Other
    These Terms and Conditions contain the entire agreement between you and SECO regarding the use of SECO’s Notification System and supersede all prior understandings related to use of the Notification System. If any part of these Terms and Conditions is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of these Terms and Conditions, and the remaining portions shall remain in full force and effect.

ADDITITIONAL SMS INFORMATION:

 

1.When you subscribe to SMS/text messaging by texting REG, SECO will send you an SMS text message to confirm your enrollment. By sending a text message for participation in the text messaging program or by using our text program at any time, you are agreeing to the Terms and Conditions set forth. These Terms and Conditions may change from time to time.

 

2.You can cancel and opt-out of the SMS service at any time. Just text STOP to 69573 to stop. We will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from SECO. If you want to join again, just text REG to 69573 to register as you did the first time. SECO will resume sending SMS messages to you.

 

3.If, at any time, you forget what keywords are supported, just text HELP to 69573 for help. SECO will respond with several keywords supported by the Notification Service. SECO is able to deliver messages to the following major mobile phone carriers and most minor carriers:

 

Major Carriers: AT&T, Verizon Wireless, Sprint, T-Mobile, U.S. Cellular, Alltel, Boost Mobile, and Virgin Mobile.

 

Minor Carriers: Alaska Communications Systems (ACS), Appalachian Wireless (EKN), Bluegrass Cellular, Cellular One of East Central IL (ECIT), Cellular One of Northeast Pennsylvania, Cincinnati Bell Wireless, Cricket, Coral Wireless (Mobi PCS), COX, Cross, Element Mobile (Flat Wireless), Epic Touch (Elkhart Telephone), GCI, Golden State, Hawkeye (Chat Mobility), Hawkeye (NW Missouri), Illinois Valley Cellular, Inland Cellular, iWireless (Iowa Wireless), Keystone Wireless (Immix Wireless/PC Man), Mosaic (Consolidated or CTC Telecom), Nex-Tech Wireless, NTelos, Panhandle Communications, Pioneer, Plateau (Texas RSA 3 Ltd), Revol, RINA, Simmetry (TMP Corporation), Thumb Cellular, Union Wireless, United Wireless, Viaero Wireless, and West Central (WCC or 5 Star Wireless), Cellcom, CSpire Wireless.
