GENERLINK PURCHASE AGREEMENT
Sumter Electric Cooperative, Inc. d/b/a SECO Energy (Utility), agrees to provide and install a GenerLink in the Member’s meter base under the following conditions:
- It is the sole responsibility of the Member to verify and ensure proper compatibility of their requested GenerLink device to operate with their generator. Upon completion of the installation of the GenerLink device, all sales are final.
- Because the integrity and accuracy of SECO Energy billing meter equipment must be maintained, SECO Energy shall have the right to interrupt the metering circuit and temporarily remove the GenerLink device to perform any tests or maintenance it determines necessary on its billing meter or related equipment. The Member also grants SECO Energy the right to disconnect the generator and ‘lock out’ the GenerLink device at any time the Utility determines there is a potential hazard.
- The Member understands and agrees that once the GenerLink device is installed, it is the only safe and allowable method for connecting a generator to the home. As a user of GenerLink, the Member further agrees to follow the GenerLink Start-Up Procedure provided in the Operating Manual. At all times, the GenerLink device shall be used solely for the purpose intended, in accordance with the Instructions and ‘Safety Tips’ contained in the Operating Manual.
- The GenerLink device must be installed by an approved installer and may not be removed or modified by anyone other than an approved installer. An approved installer is defined as a technician approved by your local electric utility (“Utility”). SECO Energy technicians are the only approved installers. The Member understands that any installation, removal, or modification by anyone other than an approved technician is dangerous and is expressly prohibited under the terms of this agreement. If the GenerLink device requires inspection, removal, repair, or replacement, the Member must contact SECO Energy to request that the GenerLink device be removed.
- The Member agrees to hold harmless and indemnify SECO Energy from any and all liability, claims or demands for the damage to property or injury or death to persons which may arise out of or be caused in any manner by any incident or occurrence involving the supplying of services under this Agreement.
- Within thirty (30) days of its installation, the Member is required to test the GenerLink device with a generator. Written notice of any defects or concerns with the operation of the GenerLink device must be received within forty-five (45) days from the installation date of the GenerLink device by Global Power Products at 225 Arnold Road, Lawrenceville, GA 30044, specifying any defects, or it shall be conclusively presumed that the Member has accepted the GenerLink device and found it to be in good operating condition and repair. This provision shall not be applicable to latent defects of which the Member could not reasonably be aware.
- Warranties are provided by the manufacturer, and all claims must be processed by Global Power Products, Inc. (1-800-886-3837). The member shall hold SECO Energy harmless from any liability in connection with the operation, service, and installation of the GenerLink system. Interruption or failure of the GenerLink system shall not constitute a breach of this agreement, nor shall SECO Energy, its officers, trustees, or employees be liable to the Member or to third parties for any damages which might result from such interruption or failure.
- Member is responsible for managing the electrical load on the GenerLink device and shall not exceed the load limits outlined in the Operating Manual.
- SECO Energy reserves the right to change, amend, or discontinue the GenerLink program or any part of the program with 30 days written notice. Notification on utility bills and in SECO Energy publications constitute written notice.
- Due to liability issues, SECO Energy will not operate the member generator for testing. Please follow startup instructions or contact Global Power Products, Inc. (1-800-886-3837).
- Service requests after the initial installation, for any reason, which require a special trip may result in a trip charge.
- Neither SECO Energy or its affiliated companies shall be liable, whether arising out of contract, tort (including negligence), strict liability, or for any other cause or form of action whatsoever, for loss of anticipated profits or savings, loss by reason of plant or other facility shutdown, non-operation or increased expense of operation service interruption, cost of purchased or replacement power, claims of Member’s or others, cost of money, loss of use of capital or revenue or any damages associated with Member’s use or intended use or inability to use the information and services provided for under this Agreement or for any special, incidental or consequential loss or damage or any nature, whether similar to those mentioned above, arising at any time or from any cause whatsoever. The total liability of SECO Energy and its affiliated companies arising from any form or case of action shall not exceed the purchase price.
- Signing this agreement form acknowledges that you have read and understood the agreement, and you give permission for SECO Energy to bill your account for the $1,200.00 + tax purchase price. You understand that this amount must be paid in full prior to the device being scheduled for installation. Upon completion of the installation of the GenerLink device, all sales are final. There are no refunds or exchanges.
